A. PUBLIC HEARINGS
1. Application #1SP 2018, Matthew Gorney for Maple And Rose, 690
Mamaroneck Avenue (Section 8, Block 82, Lot 1) for a special permit per 342-45
and Article X of the Village Code to operate a restaurant with seasonal outdoor dining
in a commercial space and as amended on April 12, 2018 the applicant is also
seeking authorization to provide eleven (11) additional off-street parking spaces offsite
within 500’ of the existing property pursuant to Article VIII, §342-54(A) of the
Village Code. The proposed restaurant requires 19 off-street spaces and the applicant
proposes eight (8) parking spaces on-site. (C-1 District)

 

2. Application #9A & 2SP 2018, Gregory Caligiuri for Green Life, 266
Mamaroneck Avenue (Section 9, Block 31, Lot 23B) for a special permit to
operate an existing self-serve salad bar restaurant pursuant to Village Code §342-45
and Article X and for a variance where the application is in violation of Zoning Code
§342-45 where ‘’in a C-2 District, no fast food restaurant, carry-out restaurant or
delicatessen shall be permitted on Mamaroneck Avenue closer than 200 linear feet to
another existing fast-food restaurant, carry-out restaurant or delicatessen on the same
side of the avenue”. (C-2 District)

 

3. Application #3SP 2018, Maya Klotsman for PFM WC-1 LLC d/b/a Orange
Theory Fitness, 651 East Boston Post Road (Section 4 Block 60B, Lot 35) for a
special permit to operate a new sports/fitness club. The proposed sports/fitness club
requires a special permit pursuant to Village Code §342-42 and Article X. (C-1
District)

 

4. Application #4SP 2018, Matthew Visconti for CAS Auto Body and Repair,
519 Waverly Avenue (Section 8, Block 101, Lot 12) for a special permit to operate
an existing motor vehicle repair shop under new management/ownership. The
proposed repair shop requires a special permit pursuant to Village Code §342-46.2
and Article X. (M-1 District)

 

5. Application #8SP 2018, Antonio Mauro for Sophia's Italian Bistro, 100 W.
Boston Post Road (Section 9, Block 50, Lot 2B) for a special permit to operate a
new restaurant in an existing restaurant space. The proposed restaurant requires a
special permit as per §342-45 and Article X of the Village Code. (C-1 District)

 

6. Application #9SP 2018, Sweet Symphony III LLC for Moonlight on the
Avenue, 308 Mamaroneck Avenue (Section 9, Block 18, Lot 17A) for a special
permit to operate a new restaurant in an existing restaurant space. The proposed
restaurant requires a special permit as per §342-45 and Article X of the Village Code.

7. Application #27A-2017, Rye Neck Realty LLC, 1621 Harrison Avenue
(Section 4, Block 65 Lot 9A) for a variance to expand the Miller Clark Animal
Hospital, a nonconforming use. The proposed expansion is in violation of Village
Code §342-64A –‘Nonconforming Use of Buildings’ where: A building or structure
the use of which does not conform to the use regulations for the district in which it is
situated shall not be altered, enlarged or extended, unless the use therein is changed to
a conforming use. (O-1/R-6 District) APPLICANT HAS REQUESTED

8. Application #2A-2018, Cappetta, Inc., 172 East Prospect Avenue (Section 9
Block 19, Lot 21A) for variances to construct a 5 story residential building with 18
lofts and on-site parking. The proposed construction is in violation of §342
Attachment 3 Schedule of Minimum Requirements where the maximum allowed FAR
is 20,000 square feet and the applicant proposes 22,671 square feet and the maximum
number of stories allowed in the C-2 District is 4 and the applicant proposes 5

9. Application #8A-2018, Charles and Lisa Reisman, 329 Stanley
Avenue (Section 9, Block 9, Lot 18) for a variance to construct additions and rear
deck. The proposed construction is in violation of §342-27 attachment 2, Schedule of
Minimum Requirements, where the combined side yard setback required is 14' and
the Applicant proposes 13.3’ and the required rear yard setback is 25' and the
Applicant proposes 21.4’. (R-5 District)

 

10. Application #10A-2018,Frank and Rona Calogero, 307 Wagner
Avenue (Section 4, Block 30, Lot 23) for a variance to construct a rear deck. The
proposed construction is in violation of §342-27 attachment 2, Schedule of Minimum
Requirements, where the required rear yard setback is 25' and the Applicant proposes
14'. (R-5 District)

nonconforming use. The applicant proposes to construct a 1 story addition over an
existing crawl space, a 1 story addition over an existing basement bedroom and a
portico over the garage entrance. The proposed additions are in violation of Village

proposed pool and equipment are in violation of Section 342-27 attachment 2,
